This website is exclusively informational in nature, in accordance with the OAB Code of Ethics and Discipline and Provimento No. 205/2021 of the Federal Council of the Brazilian Bar Association (OAB). It does not constitute an offer of services, advertising of results or solicitation of clients.
Sending a message through the contact form does not establish an attorney-client relationship, which is only formed by written contract, nor does it constitute legal advice on the matter described. The information provided here is general in nature and does not replace an individualized analysis of each specific situation.
Communications exchanged with the firm, including information provided in the initial contact, are subject to attorney-client privilege under article 7, item XIX, of Law No. 8,906/1994 (the Brazilian Statute of the Legal Profession and the OAB) and articles 25 and 26 of the OAB Code of Ethics and Discipline.
Personal Data Processed
The data processed is that voluntarily provided by the data subject in the contact form: name; email address; country of residence; subject of the inquiry; location of the assets or people involved; and a brief description of the situation. This initial contact does not request documents, civil or tax identification numbers, banking details or sensitive data (article 5, II, of the LGPD), and data subjects are advised not to include them in the initial message.
This website does not use tracking cookies, conversion pixels or third-party analytics tools (such as Google Analytics or equivalents). Technical access data, such as IP address and the date and time of the request, may be automatically logged by the hosting provider solely for security and service operation purposes.
Purpose of Processing
Data is processed solely for the purpose of: (i) assessing whether the matter reported falls within the firm’s practice areas; (ii) checking for any conflict of interest, under the OAB Code of Ethics and Discipline; and (iii) responding to the initial contact. The data is not used to send promotional communications, newsletters or any form of active client solicitation, which is prohibited under Provimento No. 205/2021 of the Federal Council of the OAB.
Legal Basis
Processing is based on the data subject’s consent (article 7, I, of the LGPD), given by checking the acknowledgment statement in the contact form, and, subsidiarily, on the controller’s legitimate interest in evaluating requests for professional contact (article 7, IX, of the LGPD). For data subjects residing in the European Union, the General Data Protection Regulation (EU) 2016/679 (GDPR) additionally applies, with processing based on consent (art. 6(1)(a)) or the controller’s legitimate interest (art. 6(1)(f)). For data subjects residing in Switzerland, the Federal Act on Data Protection (FADP/nDSG) applies, observing the principles of purpose limitation, transparency and proportionality set out therein.
Data Sharing
Personal data processed is not sold, transferred or shared with third parties for commercial purposes. Access is restricted to the responsible attorney and, when strictly necessary for providing the service, to any staff or representatives subject to an equivalent duty of confidentiality. Data may be disclosed to public authorities where required by law, court order or request from a bar oversight body.
International Data Transfer
Collected data is stored and processed in Brazil. If the data subject resides outside Brazilian territory, sending information to this website involves an international transfer of data to Brazil, which, as of this date, is not yet included on the European Commission’s list of countries recognized as providing an adequate level of protection, even though Brazil has, since 2018, adopted the General Data Protection Law (LGPD), with a protection standard inspired by the GDPR. The data subject may obtain further information about this transfer by contacting the controller directly.
Data Retention Period
Data provided in the initial contact is retained for as long as necessary to evaluate the inquiry and, if no engagement follows, is deleted within 12 (twelve) months, unless there is a legal basis for retention for a different period (article 16 of the LGPD). If the firm is engaged, data and documents related to the matter are retained for the duration of the engagement and, after its conclusion, for the applicable statute-of-limitations period and the record-retention period required by OAB rules.
Information Security
The firm adopts reasonable technical and administrative measures to protect personal data processed against unauthorized access and accidental or unlawful destruction, loss, alteration, communication or disclosure, under article 46 of the LGPD.
Data Subject Rights
Under articles 17 to 22 of the LGPD — and, where applicable, the GDPR and Swiss data protection law — the data subject may, by request to the contact email indicated on this website, seek: confirmation that processing is taking place; access to the data; correction of incomplete, inaccurate or outdated data; anonymization, blocking or deletion of unnecessary data or data processed in violation of the law; portability of data to another provider; deletion of data processed on the basis of consent; information on the entities with which the data has been shared; information on the possibility of not giving consent and the consequences of refusal; and withdrawal of consent at any time, without prejudice to the lawfulness of processing carried out prior to withdrawal.
Changes to This Policy
This policy may be updated at any time to reflect legislative changes or changes in how the website operates.
Governing Law and Jurisdiction
This policy is governed by Brazilian law, in particular Law No. 13,709/2018 (LGPD), Law No. 8,906/1994 (the Statute of the Legal Profession and the OAB) and the OAB Code of Ethics and Discipline, with the courts of the judicial district of São Caetano do Sul, SP, elected to resolve any disputes, without prejudice to any contrary legal provision.
